Biography
Wayne Geisser is a partner in Marcum’s Philadelphia office and a member of the Firm’s Advisory Services division. For 30 years, Mr. Geisser has been responsible for the management, development and analysis of accounting, economic and financial evaluation cases, generally involving matters under litigation. He has prepared and critiqued economic damage claims involving both businesses and individuals. Matters have included lost profits, shareholder disputes, various types of financial fraud and business valuations. His experience includes damages associated with casualties, copyright infringement, real estate transactions, legal and accounting malpractice, contract claims, shareholder disputes, tortious interference, catastrophic injuries and wrongful death. He has been retained to analyze a wide variety of accounting, banking and securities transactions, including those associated with the funding of international terrorism and forfeiture actions. He has provided opinions regarding misstated financial statements, including publicly traded securities. His experience includes analysis of a variety of corporate structures involving issues of control, corporate governance and “piercing the corporate veil.” Mr. Geisser has prepared and critiqued fidelity and crime bond claims. He has evaluated compliance with professional accounting and tax preparation standards. He has evaluated Medicare and Medicaid claims on behalf of various hospitals, physicians, other health care providers and the government, including Qui Tam matters brought under the federal False Claims Act. He has provided assistance to attorneys in various civil and criminal matters and internal corporate investigations. In addition, he has served variously as a receiver, monitor and special master for both federal and state courts, in connection with matters as diverse as Ponzi schemes, consumer fraud, IRS claims and shareholder disputes. He has served as a consultant to the Court in connection with tax crimes, business valuations, settlement negotiations and plans for equitable distribution. He has represented clients in connection with audits and investigations by various federal agencies including the U.S. Securities and Exchange Commission, Philadelphia Stock Exchange/FINRA, Internal Revenue Service, the Department of Defense, the Department of Health and Human Services, and the Department of Justice. He has served as consultant to the Pennsylvania State Treasurer in connection with various matters, including review of internal controls associated with the Pennsylvania Short Term Investment Pool. He has testified as an expert on numerous occasions in federal and state courts, as well as various ADR forums and stock exchange proceedings.
